This website is owned and operated by "Travel with Nilame", based in Habarana, Sri Lanka. By accessing and using this website, you agree to be bound by the following terms and conditions. If you do not accept any part of these terms and conditions, please refrain from using this website.

These terms and conditions apply to all bookings made through "Travel with Nilame". All prices are quoted in USD. These conditions govern your relationship with "Travel with Nilame" and outline our obligations regarding any booking made on your behalf. Please read these terms carefully before making a booking. By using the website or engaging in written communication with "Travel with Nilame" for travel arrangements, you confirm that you are 18 years or older and fully accept these booking conditions.

All information you provide must be true and accurate and will be treated confidentially.

Holiday / Tour Contract

Bookings made directly through the "Travel with Nilame" website will be confirmed once you have sent an online confirmation and paid the required deposit or the full amount. Once your payment is received and acknowledged, a binding contract is formed, and you are deemed to have accepted these booking conditions, which are governed by the laws of the Democratic Socialist Republic of Sri Lanka.

"Travel with Nilame" does not provide accommodation but offers a range of customized tours and experiences. 

Final Payment

If a balance of payment is due for your travel arrangements, it must be paid 10 days prior to the start of your tour. 

Methods of Payment

Payments for travel arrangements can be made via:

1. PayPal (for international clients)

2. Bank Transfer (for local clients)

Please note that all additional bank charges and fees related to transfers will be borne by you.

Bank Transfers

Bank transfers should be made to the following local accounts:

- Bank Name:  [Insert Local Bank Name]

- Account Name: [Insert Account Name]

- Account Number: [Insert Account Number]

*Customers are responsible for all bank charges in the case of a bank transfer.

Payment Schedules

- For bookings made 0 to 20 days before the arrival date: Full payment is required at the time of booking.

- For bookings made more than 20 days before the arrival date: A minimum deposit of 25% of the total amount is required, with the balance due 20 days prior to arrival.

Travel with Nilame" reserves the right to cancel your booking if payment is not received within the stipulated period.

Amendments and Cancellations

While we strive to provide all travel arrangements as confirmed, reasonable changes may be made after notifying you.


**Cancellation Policy for Normal Bookings:**

You may cancel your booking at any time, provided you do so in writing. To protect yourself, we recommend purchasing travel insurance at the time of booking. The following cancellation charges apply:


- **30 to 45 days before the tour:** 25% of the tour cost will be charged.

- **14 to 29 days before the tour:** 50% of the tour cost will be charged.

- **8 to 13 days before the tour:** 75% of the tour cost will be charged.

- **Less than 7 days before the tour:** No refund.


*The cancellation must be received in writing. The tour start day is not considered in the computation of the period.*


**Cancellation Policy for Special Offers:**

Cancellations on special offers may be non-refundable. Please check the specific offer details.


**Cancellation Policy for High Peak Period:**

Bookings made for or during the 'High Peak' period (20th December to 10th January) are non-refundable.


**Cancellation Policy for Amended Bookings:**

The cancellation policy applies to the original date of arrival and not to the extended date of arrival. If the date of arrival is brought forward, the cancellation policy will apply to the amended date.


#### **Child Policy**


- **Children below 5.99 years:** Free of charge on existing bedding.

- **Children between 6-11.99 years:** 50% off the adult rate (up to a maximum of 2 children sharing the parents' room).


#### **Cancellation by Us**


Your booking is important to us, and we will take all necessary precautions to ensure that your expectations are met. However, we reserve the right to cancel the booking in the event of unforeseen circumstances beyond our control. In such cases, we will refund all monies paid by you and, wherever possible, offer an alternative tour of comparable type and quality. **Travel with Nilame** cannot be held liable for any incidental expenses that may be incurred by you.


#### **Our Liabilities & Limitations**


All itineraries are sample schedules intended to give you a general idea of the likely plan. Factors such as weather, road conditions, and the physical ability of participants may dictate itinerary changes either before or during the tour. We reserve the right to change any schedule in the interests of participant safety, comfort, and well-being.


We shall not be responsible for any delays, alterations in the program, or expenses incurred directly or indirectly due to natural hazards, flight cancellations, transportation breakdowns, weather, sickness, landslides, political instability, or any other incidents beyond our control.


We are not liable for any losses, injury, or damage to persons or property arising directly or indirectly from accommodation, transportation, or other services. Visitors are advised to seek travel insurance in their home country to cover any potential risks.


#### **Health, Passport, and Visas**


It is your responsibility to ensure that you and your party obtain the necessary inoculations and medical advice before traveling. Similarly, it is your responsibility to ensure that you have the correct and valid passports, visas, and other requirements pertaining to your travel arrangements before the holiday commences. **Travel with Nilame** will not be held responsible for your failure to obtain the correct travel documents.


#### **Travel Insurance**


We strongly recommend that you take out personal travel insurance at the time of booking for all members of your party. It is your responsibility to ensure that the insurance you purchase is adequate.


#### **Breakages and Damages**


You are responsible for any breakages, losses, or damages caused by you or a member of your party during your tour. It is your responsibility to put right any damage or to make full payment before the end of your tour.


#### **Behaviour**


You are responsible for complying with all relevant regulations governing your carriage by air or any other mode of transport and your conduct during the tour. If your behavior is deemed disruptive or dangerous, **Travel with Nilame** reserves the right to terminate your reservation without responsibility for any costs or claims that may arise.


#### **Severability**


If any of these booking conditions are deemed invalid or unenforceable, all other provisions of these conditions shall remain valid and enforceable.


#### **Complaints**


We aim to resolve any reasonable complaints amicably. If a problem arises during your tour, you must communicate it immediately to **Travel with Nilame** staff. If the issue is not resolved, please submit a formal written complaint within 28 days of your return.


#### **Exclusions of Liabilities**


**Travel with Nilame** strives to ensure that all information on this website is accurate, but we do not guarantee that it is free from errors or omissions. All recommendations, opinions, and prices regarding destinations are provided for guidance only, and reliance on them is at your own risk.


We are not liable for any discrepancies between website content and third-party services. Additionally, **Travel with Nilame** will not be held liable for any indirect, incidental, special, or consequential damages, loss of profits or revenue, injury, or damage to persons or property unless it is proven to be due to our negligence.


#### **Electronic Communication**


By using this website or sending us emails, you consent to receive electronic communications from **Travel with Nilame**. All notices, disclosures, agreements, and other communications provided electronically satisfy any legal requirement for communication to be in writing.


#### **Governing Law and Jurisdiction**


When your booking is confirmed with us, a contract between **Travel with Nilame** and you is constituted. This contract and these booking terms and conditions shall be governed by the laws of Sri Lanka.


#### **Force Majeure**


**Travel with Nilame** shall not be liable for any failure to perform its obligations if such failure is due to events beyond our reasonable control, including but not limited to acts of God, war, civil disturbances, strikes, or other events beyond our control.


Validity

These terms and conditions are valid from 7th January 2024.
